Observations Every Business Should Review Before Filing GSTR-9 and GSTR-9C: IGST Instead of CGST-SGST: Correct Tax, Wrong Head, Real Cash-Flow Pain
“The total tax may be correct, but the wrong tax head can still create a real liability.”
Paying the correct total amount of GST under the wrong tax head is still a compliance error.
The audit issue
Incorrect place-of-supply or location analysis may result in IGST being paid instead of CGST plus SGST, or the reverse. Common causes include bill-to ship-to transactions, services performed across states, fixed-establishment questions, event services, transportation, installation and supplies involving SEZ units. The error may not change the total tax arithmetic, but the law generally requires payment under the correct head followed by a refund process for tax paid under the mistaken head.
Legal framework
Sections 10 to 13 of the IGST Act determine place of supply, while sections 7 and 8 determine inter-State and intra-State character. Section 77 of the CGST Act and section 19 of the IGST Act address tax paid under an incorrect classification of the supply. The refund procedure and limitation rules must be checked for the relevant facts.
What the officer will examine
Officers compare customer GSTIN, place of supply, ship-to address, contract, delivery evidence and tax head shown in GSTR-1 and GSTR-3B. They test transactions with branches, SEZs and customers having multiple registrations. E-invoice and e-way bill data can expose inconsistent state codes even when accounting entries look balanced.
What to correct before GSTR-9 and GSTR-9C
For GSTR-9/9C, run a state-code and tax-head validation across sales invoices. Separately review services with special place-of-supply rules. Quantify incorrect-head cases invoice by invoice, pay the correct tax through the legally appropriate route and preserve refund eligibility documents for the original payment. Do not simply pass a year-end journal or offset one head against another; electronic ledgers and statutory liability operate separately.
Closing takeaway
Place of supply is not a clerical field,it decides which government receives the tax. A professional annual review should challenge the tax head before an audit officer challenges the entire transaction trail.
Practical audit scenario
A Gujarat supplier bills goods to a Maharashtra customer but delivers them to a Gujarat site on the customer’s instruction. Selecting the customer GSTIN state automatically as place of supply can produce the wrong head if the statutory bill-to ship-to rule and transaction documents are not examined. Service transactions can be even more fact-sensitive. Build decision rules for recurring transaction types and separately review exceptions. Where tax was paid under the wrong head, keep the original payment, correct payment and refund trail distinct so neither liability nor recovery is duplicated.
The safest approach is to identify and document the issue before the annual return is filed. Once an audit communication is issued, correction options may narrow and every explanation must be supported by records. The review should therefore record the factual position, legal conclusion, amount involved, return impact, corrective action, owner and supporting documents. Material positions should be approved, while immaterial differences should still be catalogued so repeated small errors do not become a pattern across tax periods. This converts a year-end reconciliation into a defensible audit file.
Before finalising your annual return, consider an independent GST reconciliation and health check focused on the records an audit officer is most likely to test.
